The agreement
By creating an account, connecting a mailbox or otherwise using Macklore, the customer organisation and every user acting on its behalf accept these terms. Where a separate written agreement or order form is signed for an Enterprise plan, that document governs any point it addresses and these terms cover the rest.
Who may use the service
Macklore is a business tool, supplied for use by organisations and by individuals acting for an organisation. By signing up you confirm that you are authorised to bind the organisation named in your account, and that you are not barred from receiving the service under applicable law or sanctions rules.
Accounts and access
- Credentials are personal to each user and must not be shared between people
- Seats are counted per named user, so one login covering several reps is not permitted
- Account administrators are responsible for inviting, scoping and removing users promptly
- Suspected unauthorised access must be reported without delay so sessions can be revoked
Role scoping matters here. A rep-level account and a manager-level account see different pipelines by design. Using an elevated account to give someone visibility they were not granted is a breach of these terms.
Connected mailboxes and data sources
Engagement scoring depends on activity data from mailboxes, calendars, call logs and document links. When you connect a source, you confirm that:
- You are entitled to connect that account and to have its activity processed for CRM purposes
- You have met any notice or consent obligations owed to the people whose data it contains
- You will not connect a mailbox belonging to someone who has not authorised it
- You will not import call recordings or transcripts, which the service neither requests nor processes
Macklore will not send messages from a connected mailbox except when a user presses send on a suggestion inside the product. That limitation is part of the service and is not configurable.
Acceptable use
You agree not to use Macklore to:
- Send unsolicited bulk messaging, or to operate outreach that breaches applicable marketing law
- Track individuals for a purpose unconnected to a genuine commercial relationship
- Store special category personal data where the service was not designed to hold it
- Reverse engineer the scoring engine, or extract it in order to build a competing product
- Resell, sublicense or provide the service to a third party except under an Enterprise agreement
- Place deliberate load on the platform beyond normal use, or probe it without written authorisation
How scores and suggestions may be used
Engagement scores, risk flags and drafted follow-ups are decision support for sales work. They describe recorded behaviour on a deal and they are not an assessment of any individual.
- They must not be used as a sole or primary input to employment decisions about a rep
- They must not be used for credit, insurance, housing or similar assessments of a buyer contact
- They must not be presented to a third party as a guarantee of outcome, because they are a probability read rather than a prediction of fact
Every suggestion requires human review before it reaches a buyer. You remain responsible for the content of any message your team sends.
Your data and ownership
- Pipeline, contact, account and activity data recorded in your workspace remains yours
- We process it to deliver the service and for no independent commercial purpose of our own
- It is not sold, licensed or shared with third parties for marketing
- It is not used to train models that serve other customers
- Full export in open formats is available on demand, on every plan, without prior approval
We may use aggregated, de-identified statistics about service usage to improve the product, provided they cannot reasonably be attributed to you, your workspace or any named contact.
Trials
- A trial runs for the stated period on the stated feature set and does not require a payment card
- At the end of a trial the workspace becomes read-only rather than being charged automatically
- Read-only workspaces remain exportable, so trial data is never trapped
- Trials are offered per organisation, and repeated trials to extend free use are not permitted
Plans, billing and changes
- Fees are charged per named user, per month, on the plan selected, exclusive of applicable taxes
- Annual plans are invoiced in advance for the term and are not auto-renewed without prior notice
- Adding seats mid-term is charged pro-rata from the date the seat is created
- Upgrades apply immediately; downgrades take effect at the next renewal so views are not lost mid-quarter
- Price changes are notified ahead of a renewal and never applied inside a paid term
- Unpaid invoices may lead to suspension after written reminders, with export access preserved
Availability and support
We aim for continuous availability and will give advance notice of planned maintenance where it is likely to be noticeable. Support is provided through the channel stated for your plan, during business days.
Activity capture depends on third-party mail, calendar and telephony providers. Where one of those providers is unavailable or changes its interfaces, scoring may be delayed for affected deals until the connection recovers. Captured history is not lost in that situation.
Our intellectual property
The Macklore application, the scoring engine, the interface design, the brand and the documentation remain our property. You receive a non-exclusive, non-transferable right to use the service during your subscription, and nothing in these terms transfers ownership of any part of it.
Feedback you choose to send us about the product may be used to improve it without obligation, and sending feedback does not give us any right to your pipeline data beyond what is described above.
Disclaimers
The service is provided on a commercially reasonable basis. We do not warrant that an engagement score will be correct about any particular deal, that a flagged deal would otherwise have been lost, or that a suggested follow-up will produce a reply. Sales outcomes depend on judgement, timing and the buyer, and none of those are within our control.
Limitation of liability
To the extent permitted by law, neither party is liable for indirect, incidental, special or consequential loss, including lost profit, lost revenue, lost deals or lost anticipated savings. Our total aggregate liability is limited to the fees paid for the service in the twelve months before the event giving rise to the claim.
Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud.
Suspension
Access may be suspended where there is a serious breach of acceptable use, a security risk to the platform or other customers, a legal requirement to do so, or sustained non-payment after notice. Except where immediate action is needed to protect the platform, we will give notice and an opportunity to put the matter right, and export access is preserved during suspension.
Cancellation and exit
- You may cancel at any time from account settings, without needing to speak to anyone
- Annual plans run to the end of the paid term unless agreed otherwise in writing
- After cancellation, workspace data stays exportable for ninety days and is then deleted
- Deletion can be requested earlier and will be actioned rather than deferred
Governing law
These terms are governed by the laws of India, and the courts of Delhi have exclusive jurisdiction over any dispute arising from them. Before beginning proceedings, both parties agree to raise the issue in writing and allow thirty days for a good-faith attempt to resolve it.
Changes to these terms
These terms change when the product or the law changes. Material changes are notified to account administrators in the application and by email ahead of taking effect. Continued use after that point constitutes acceptance, and where a change is unacceptable you may cancel and export your data in full.
